Terms of Service

1. Purpose
These Terms of Service (the "Terms") govern your access to and use of SwiftHive (the "Service"), an automated hybrid app building solution provided by The Suwan News ("Company"). By using our Service, you agree to be bound by these Terms.
2. Definitions
- User: Any individual or entity accessing the Service.
- Member: A user who has registered an account with a verified email.
- App Build: The process of generating mobile application files (APK, AAB) using the Service's automated engine.
- Plan: Subscription tiers (Free, Pro, etc.) that define the scope of available features and limits.
3. User Obligations
Users shall not engage in the following prohibited activities:
- Unauthorized use of another user’s account or credentials.
- Reverse engineering, duplicating, or distributing the Service’s engine or templates.
- Creating apps for illegal websites (e.g., gambling, adult content, copyright-infringing material).
- Interfering with the normal operation of the Service.
4. App Building and Payments
A. Service Plans: Users may build apps according to their selected Plan (Free or Pro).
B. Payments: For the Pro Plan, the build process begins upon successful payment via Stripe or other designated methods. All prices are in USD unless stated otherwise.
C. Refunds: Due to the nature of digital content and automated processing, refunds may be restricted once the build process has commenced. We provide re-build opportunities or refunds only in cases of technical system failure.
5. Intellectual Property
The User must hold the legal rights to the web URL and logo used for the build. The Company is not liable for any copyright infringement or legal disputes arising from User-provided content. The Company retains all rights to the underlying software and templates of the Service.
6. Limitation of Liability
- The Company does not guarantee that the generated apps will be approved by third-party app stores (Google Play Store, Apple App Store). Store approval is subject to the respective platform's policies.
- The Company is not liable for service interruptions caused by force majeure, including natural disasters or ISP failures.
- The Company is not responsible for any loss of profit or data resulting from the use of the Service.
7. Termination
Users may terminate their account at any time. Upon termination, all build history and generated files will be permanently deleted and cannot be recovered.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from the use of the Service shall be subject to the exclusive jurisdiction of the courts located in the Company's registered address.
